Terms & Conditions and Booking agreement for renting from So Cal Hot Properties
LLC We
thank you for thinking of us for your next vacation lodging.
Please read the following terms. To secure your dates a 30%
deposit is required and full payment is due 60 days prior to
check in. Both you and So Cal Hot Properties LLC reserves the right to
cancel a reservation within 48 hours of receiving it, upon final
confirmation all confirmed booking are firm, no refunds for
cancellations. All bookings received 2 weeks prior to check in
must be paid in full by credit card. You
must be 25 years of age to book a property and we have a 3 day
minimum. Any bookings made through the web site are pending
until they are accepted by the owner and a signed copy of the
contract is received along with a copy of the drivers license.
If your booking is not accepted we will refund your account
right away.. If you wish to book within 60 days full payment is due
at the time of bookings. No refunds for cancellations so we suggest that you insure your
trip with Travel
Guard
(for only a fraction of your rent everyone in your group is insured) in
case you need to cancel due to a medical emergency, weather.... For more information about standard vacation rental policies please click

guard or give us a call. The deposit holds your booking, and there are additional fee's (ex. cleaning, processing and applicable
taxes) that are quoted by the web site but may change or be less
(ex. if you pay by check you get a discount).
Fee's vary by each property. Please see the description for each
property for more information. $55 Security
Deposit Protection Pan- Security deposits are required on
some properties, and generally range from $500 to $10,000. They
are refunded within 30 days after your departure assuming there
are no damages to the property. We do require that you
purchase a $55 insurance plan that covers the home for
accidental damage during your stay. Our guests really enjoy

Please provide a copy of your drivers license and a printed
version of this contract signed by you via fax 949-313-0935 or
email socalhotproperties@gmail.com. If your drivers license and
or signed contract is not received within a timely manner the
contract can be canceled and your funds will be refunded but we
will make multiple attempts to contact you before canceling your
booking.
Payment
Terms: If any of the charges are not correct
such as you are being charged the full amount instead of only
30% (the full amount is due within 60 days of check in) send
us an e-request instead of a reservation and adjust your
account, otherwise you are accepting the charges below as
stated. All bookings received 2 weeks prior to
check in must be paid in full by credit card.We accept Credit Cards (we offer a discount for checks),
Check or money order made out to: So Cal Hot Properties LLC. There is a $25
charge for all returned checks plus the cost of collection. Once
payment is received we will email you the check in instructions.
If payment is not received 45 days prior to check in your credit
card will be charged in full.

Excessive
Damages/ Security deposits: I understand that my credit card can be used
to pay for damages. You
have paid for light cleaning but if the house requires heavy
cleaning you will be charged extra. Heavy cleaning is for
example, when wiping down hardwood floors it is not good enough
and it needs a Professional cleaning due to spills and or
damage. Security Deposit Protection provides you with peace of
mind, giving you up to $1,500.00 worth of coverage against
accidental damage. However, the guest is fully liable for any
malicious damage, damage due to gross neglect or misuse of the
property, and/or need for excessive cleaning. Costs incurred for
the repair or cleaning of any such abuse to the property, will
be charged against the guests credit card and such charge will
be preauthorized. Security deposits are required on some
properties, and generally range from $500 to $10,000. They are
refunded within 30 days after your departure assuming there are
no damages to the property.

Cancellation:
If there is a chance that you may need to cancel we suggest
getting the Travel Insurance form Travel Guard to insure your
trip, please read the terms and conditions of the insurance by
clicking on the link found the terms and conditions section of
So Cal Hot Properties. Once your booking is confirmed their are
no refunds for cancellations.

No Parties: No
parties/ gatherings without permission or excessive noise
allowed or you will forfeit all or a portion of any charges or
preauthorizations put against your credit card. This means no
extra people than the people in your group listed above. All of
our homes are NO SMOKING homes, breach of the no smoking clause
may result in a $200 charge.

Deposit:
A deposit of 30% of the total due must be paid in order to
confirm your reservation. You must show proof that you are 25
years of age in order to rent and be a guest staying at the
property during the rental period and provide a clear copy of
said persons ID before the booking is final. The guest is
responsible for all damages and excessive cleaning of the unit
caused by the group. Payment in full is due 60 days prior to
your check in. If Payment is not received 45 days prior to check
in your credit card will be charged in full.

Check-In
and Out: Check-in is anytime after 4 pm. Check out is
at 10am. Upon full payment, signed contract and copy of ID we
will provide you with a code to let yourself into the property.
Please do not check in early or check out late otherwise we will
not have time to prepare the home for the next group and you may
be charged an extra day.

Terms:

card details and a copy of your drivers license is received via

account ASAP. By signing this contract you
authorize So Cal Hot Properties LLC to pre authorize your credit
card up to $1000 which can be converted to a charge and may not
be refunded in the case of damages, early or late check out,
excessive cleaning or breach of this contract in any way which
includes but is not limited to the following: No pets are
allowed. NO parties, NO excessive noise, NO smoking in the
homes, No gatherings with more people than that stated in the
contract. If this contract is breached you may be removed from
the premises with out a refund. We
cannot be held responsible for or be liable in respect of loss,
damage or changes caused by FORCE MAJEURE (i.e. war, strikes,
floods, airport closure, adverse weather conditions, riots,
terrorist activity, fire, natural or nuclear disasters,
foreclosure, sale of property etc).

Waiver of Liability, Assumption of
Risk and Protection Agreement
Waiver: In consideration of being permitted to
participate in activities (hereinafter called “The Activity)
associated with the rental of vacation rental from So Cal Hot
Properties, including but not limited such actions as riding
bikes, swimming in pool, playing tennis, cooking, barbecuing and
other uses of this property for I, myself, my heirs, personal
representatives, friends or assigns and fellow guests and
renters, do hereby release, waive, discharge, and covenant not
to sue the owners of properties represented by So Cal Hot
Properties and owners and employees of So Cal Hot Properties
from any and all claims including negligence resulting in
personal injury, accidents or illnesses (including death), and
property loss arising from, but not limited to "The
Activity".

Assumption of Risk:
Participation in "The Activity" (riding bikes,
Jacuzzi, pool…) carries with it certain inherent risks that
cannot be eliminated regardless of care taken to avoid injuries.
The specific risks vary from one activity to another but risks
range from minor injuries such as scratches, bruises, and
sprains; major injuries such as eye injury, joint or back
injuries, hear attacks and concussions to catastrophic injuries
including paralysis and death.
I _________________have read the previous
paragraphs and I know, understand, and appreciate these and
other risks that are inherent in "The Activity." I
hereby assert that my participation is voluntary and that I
knowingly assume all such risks.
Indemnification and Hold Harmless: I also agree
to INDEMNIFY AND HOLD the So Cal Hot Properties, its members and
clients HARMLESS from any and all claims, actions, suites,
procedures, costs, expenses, damages, and liabilities, including
attorney’s fees brought as a result of my involvement in The
Activity and to reimburse them for any such expenses incurred.
Severability- The undersigned further expressly agrees that the
foregoing waiver and assumption of risks agreement is intended
to be as broad and inclusive as is permitted by law of the state
of California and that if any portion thereof is held invalid,
it is agreed that the balance shall, notwithstanding, continue
in full legal force and effect.
Acknowledgment of Understanding: I have read this waiver of
liability, assumption of risk, and indemnity agreement, fully
understand its terms, and understand that I am giving up
substantial rights, including my right to sue. I acknowledge
that I am signing the agreement free and voluntarily, and intend
by my signature to be a complete and unconditional release of
all liability to the greatest extent allowed by law.
